Article 1 Purpose

The following general terms and conditions of sale govern all transactions established on the VILLA MALAA'IKA website. Any reservation made on this site implies the customer's unconditional and irrevocable acceptance of these conditions.

Article 2 Price

The prices mentioned on the website are indicated in Euros, VAT included, are valid at the time of their consultation by the customer and are those in force at the time of booking.

Article 3 Payment

This contract is a distance contract which aims to define the rights and obligations of the parties in the context of booking a stay at VILLA MALAA'IKA on the Internet, through the secure payment platform PAYZONE present on the site www.malaaika.com

VILLA MALAA'IKA has chosen the PAYZONE payment platform to secure online credit card payments. The validity of the customer's payment card is verified by PAYZONE. The payment card may be refused for several reasons: stolen card, blocked card, limit reached, input error... In case of problem, the customer must contact their bank on the one hand, and the guest house on the other hand to confirm their reservation and payment method.

To settle your reservation at our establishment, a secure PAYZONE payment link will be sent to you by email for payment of your stay. Accepted payment cards are: Visa and Mastercard.

Article 4. Reservation Cancellation Conditions

The customer is reminded, in accordance with Article L221-28 of the Consumer Code (law n° 31-08), that they do not have the right of withdrawal for a contract relating to accommodation services.

In case of cancellation of the reservation, the deposit paid through the payment link will be fully non-refundable. The balance of your stay is to be paid at least 1 month before your arrival and is also non-refundable.

Article 5 Data Confidentiality

The information requested from you is necessary for processing your reservation and is treated confidentially. You have a right of rectification regarding data concerning you.

In particular, during online payment, the customer's bank details must be transmitted by the payment service provider PAYZONE to the guest house's bank, for the execution of the hotel reservation contract. However, the customer consents to this transfer necessary for the execution of their reservation by the PAYZONE payment platform in their capacity as a professional, they have committed to VILLA MALAA'IKA to take all security and confidentiality measures for said data transfers.

Article 6 Force Majeure

Force majeure means any event external to the parties presenting both an unforeseeable and insurmountable character that prevents either the customer or the hotelier from fulfilling all or part of the obligations provided for in the contract. Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of the Courts and Tribunals of Marrakech.

Each party cannot be held responsible towards the other party in case of non-performance of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the cost of the resulting expenses.

Article 7 Dispute Resolution

The customer is informed by VILLA MALAA'IKA of the possibility to resort, in case of dispute relating to these general conditions, to a conventional mediation procedure or any other alternative dispute resolution method, chosen by the competent authorities of Marrakech.

Article 8 Applicable Law

These General Terms and Conditions of Sale are governed by Moroccan law without prejudice to any applicable mandatory protective provisions of the country of residence of consumers
